The IT Service Provider (ITP) is an entity that is empowered to administer a specific IT service provision with an appropriate infrastructure. The ITP establishes and maintains an infrastructure through which the IT service is delivered (e.g., by delivering the service to the ITP); however, it may maintain or replace its IT services unless:
(1) it has already been deemed effective by a national authority; or
(2) in the case of a request to reconfigure a service, the ITP has no duty to perform such reconfiguration; or
(3) in the case of a request for a new service, the ITP has no duty to perform such reconfigure; or

(5) it fails to comply to the requirements of this Act with respect to the IT service provider or with the requirement to treat its IT service as complying with any requirements of this Act.
(b) IT services provided for in paragraph (a)(3) must consist of a fixed fixed transmission medium used to connect two or more networks to a single Internet service provider.
